Heath Steinbeck prevails in New York on matter of first impression under Federal Arbitration Act
The firm recently defeated a petition brought under the Federal Arbitration Act to compel testimony of a California witness in a New York arbitration. The dispute involved a matter of first impression in the Second Circuit as to whether a witness could be compelled under the Act to provide video testimony in California in a proceeding taking place in New York.
Heath Steinbeck obtains summary judgment for restaurant group
The firm obtained summary judgment on all claims in the San Bernardino Superior Court for an international restaurant, retail, and wholesale industrial baking company defending a former employee’s claims of negligence. Prior to filing the motion, the firm obtained key material admissions from the plaintiff, as well as sanctions for discovery abuse. The court granted the motion outright, finding that the client owed no duty to the plaintiff as a matter of law.
