Heath Steinbeck obtains summary judgment for restaurant group
The firm obtained summary judgment on all claims in the San Bernardino Superior Court for its clients, an international restaurant, retail, and wholesale industrial baking company in a negligence lawsuit brought by a former employee. Prior to filing the motion, the firm obtained key material admissions, as well as sanctions for discovery abuse. In its motion, Heath Steinbeck argued that its client was a special employer of a temporary worker hired through a staffing agency, successfully invoking the doctrine of workers’ compensation exclusivity defense as a matter of law.
